Access to this website is only provided pursuant to an access agreement executed between your organization (“Participant”) and Asembia. You (the "User") agree and acknowledge that User and Participant are bound to this access agreement, including but not limited to obligations regarding the prohibitions against sharing information with persons not authorized to receive such information, as well as compliance with relevant laws, rules, and regulations such as the Health Insurance Portability and Accountability Act (“HIPAA”).
Both User and Participant confirm and agree that they have reviewed and will continue to review the information contained, received, or derived through use of this site (“Information”). The Information may contain protected health information (“PHI”) as defined by HIPAA, and both User and Participant confirm that: (a) the Information does not contain PHI or potential PHI; or (b) the Information may have PHI but both the User and Participant acknowledge and accept its responsibilities under HIPAA. Some examples of responsibilities or obligations under HIPAA which may or may not apply to either User or Participant include requiring a Business Associate Agreement to transmit PHI in certain scenarios, ensuring the security and privacy of PHI under the User or Participant’s care, and criminal liability for certain actions taken in violation of HIPAA.
Both User and Participant agree that Asembia shall have no liability as it relates to any action taken by either the User or Participant in violation of HIPAA, and both User and Participant agree to hold harmless Asembia LLC and its affiliates in such a scenario. As part of our security measures and obligations, an audit trail is maintained of users accessing patient records.
